Arizona Uninsured and Underinsured Car Insurance Coverage-Buy it. The benefits of having Uninsured (UM) and Underinsured (UIM) Coverage on your Auto Insurance are significant, and here is why: The cost of the coverage is very cheap, and will compensate you for unpaid medical bills, etc. There are limits to everyone’s liability insurance policy, and once exhausted, no more can be recovered from the liability insurer. A driver injured in an Arizona Car Accident is left holding the bag for the remaining medical bills, pain and suffering, etc. Yes, you could pursue the negligent driver who caused the Accident personally, but a vast majority of the time there are no personal assets to recover. For example, you are involved in a Serious Car Accident and suffer a broken arm and broken leg, which result in medical bills that total $50,000. The at fault driver’s insurance policy has a $15,000 limit. If you do not have uninsured/ underinsured coverage you’re on your own to pay the remaining $35,000. If you have have Underinsured coverage your own insurance will cover the rest. Furthermore, this will not effect your insurance premium. Another important advantage of having these policies is in situations when the at fault driver does not have insurance. Your Uninsured policy will cover your expenses. Arizona Law mandates that every insurance company must offer you UM/UIM. The limits on these policies must not be less than bodily injury liability limits. I highly advise you to get both!! To determine if you have Uninsured and Underinsured policies look at your insurance declaration page. If you do not have these policies, GET THEM TODAY. Feds sue Bank of America for alleged Mortgage Fraud. The United States Attorney in the Southern District of New York has filed a lawsuit against Bank of America. The Justice Department is alleging that Bank of America engaged in fraud with “the Hustle” program. The complaint alleges that fraudulent mortgages were purchased by Fannie Mae and Freddie Mac, and resulted in $1 Billion losses for taxpayers and numerous foreclosures. “The Hustle” is a nickname for BofA’s “High Speed Swim Lane” program. This program streamlined the mortgage origination process, however, the government stated in their complaint the program was “intentionally designed to process loans at high speed and without quality checkpoints, and which generated thousands of fraudulent and otherwise defective residential mortgage loans.” Countrywide is blamed for starting the program and BofA continued it when they bought the fledgeling company in 2008.

Arizona Car Accident Jury Verdicts-Some useful personal injury facts. I read some interesting facts online that are worth sharing to Phoenix Arizona Car Accident victims. 27% of all Arizona car accidents are rear-end collisions, 13% intersection accidents, 12% turning collisions, 11% truck accidents, 9% chain reaction accidents and 8% “other. After a car accident in Arizona you have the right to negotiate with the at fault driver’s insurance adjuster personally, or hire a personal injury lawyer. If you have a straight forward case where the facts are in your favor, negligence is clear and damages are substantiated, you may be successful in negotiating a favorable personal injury claim. If you have any issues during the process, it is in your best interest to hire an experienced Phoenix Arizona car accident lawyer. We know exactly how to properly gather facts (discovery of evidence, deposition of witnesses, etc.), draft demands, and negotiate with aggressive insurance adjusters. Our goal is to negotiate a favorable personal injury claim on your behalf, in order to maximize your recovery and make you whole again. One of the main reasons we like to avoid litigation, is that only 53% of plaintiffs in trials win money damages. This means that you take a major risk by going to trial. The average damage award in an Arizona car accident case is $16,929, but keep in mind this amount includes hours of personal injury lawyer fees. Attorney Dan Marco has spent the last 25 years handling car accident personal injury claims, and through the years, has developed a very unique and successful negotiation strategy. When he speaks to insurance adjusters, they listen, because they know he has done the work necessary to prove the case. He works tirelessly, gathering facts and evidence, speaking with witnesses, and drafting effective demand letters. Arizona unemployment and Bankruptcy.
Arizona unemployment and Bankruptcy. By now many of us hoped and believed that the economy would improve. Recent gloomy job and housing reports indicate that we are far from the end. To this day, I am meeting w/ new clients who have recently lost their job, which means employers are still hurting and need to cut costs (i.e. Bank of America recently laying off 30,000 employees). What is the best course of action when one loses their job and is immersed in uncontrollable debt? How can you best prepare to regain financial stability? In an attempt to stay afloat, many turn to credit in order to maintain their lives, hoping to survive until the next job comes. Others liquidate their retirement accounts to keep their heads above water. The unfortunate reality is that attaining a new job is very difficult these days, and both these strategies to maintain lifestyles/pay debt can be extremely detrimental to you. If you are using a credit card to pay monthly bills (utilities, other unsecured debts, etc.) you are digging yourself deeper and deeper in debt. In our experience this “robbing Peter to pay Paul” strategy is not effective. For most, the result is greater debt, which creates greater financial stress. Furthermore, bankruptcy can discharge your credit card debt, however, your spending is under extreme scrutiny, and a creditor can object to recent debts being discharged. What upsets me the most is when clients liquidate their retirement accounts to pay debt, yet end up filing bankruptcy. Had they filed bankruptcy prior to this, they could have saved their retirement. In a bankruptcy, a debtor’s retirement accounts are 100% exempt, meaning they can usually discharge their debts and keep all their retirement funds. There are many pieces to the financial puzzle. It is very important to get advice as soon as you feel financial stress. At Mostafavi, Marco & Wimmer we take pride in consulting clients on their most advantageous debt relief options. Keep in mind most everything you do prior to filing a bankruptcy is subject to scrutiny in the bankruptcy court, therefore, it is vital you get educated early. During our free consultation, we will guide you in order to best prepare you for a successful bankruptcy filing.
